Mandatory legal clearance letter issued by banks and NBFCs upon full loan repayment to release mortgaged property deeds, remove RTO hypothecation, and update CIBIL records
Under RBI directive RBI/2023-24/60, if your lender fails to release your original property documents or issue an NOC within 30 days of full loan repayment, the lender must pay you compensation of ₹5,000 for each day of delay.
💡 A Loan No Objection Certificate (NOC), also known as a No Dues Certificate (NDC) or Loan Closure Letter, is a formal legal release issued by a lending institution. It certifies that the borrower has settled all debts in full and that the lender retains no lien, charge, or security interest over the borrower's mortgaged real estate, pledged vehicle, or personal assets.
Distinct legal instruments required across different types of borrowing.
| Document | Primary Loan Type | Issuing Body | Final Destination / Purpose |
|---|---|---|---|
| No Dues Certificate (NDC / NOC) | All loan categories (Personal, Business, Home, Auto) | Bank / NBFC Credit Operations | Legal proof of zero debt; CIBIL rectification |
| Form 35 (Twin Copies) | Vehicle / Automobile Loans | Bank Authorized Signatory under MV Act | Submitted to local RTO to remove bank name from RC |
| Deed of Reconveyance / Release Deed | Home Loans with Registered Mortgage | Bank Legal Department & Sub-Registrar | Registered at Sub-Registrar Office to clear EC title |
Statutory limit of 30 days under RBI guidelines; instant download for digital personal/consumer loans via Net Banking.
100% Free of cost (RBI prohibits banks from charging any fee for issuing an NDC or returning original title deeds).
Any primary borrower, co-borrower, or legal heir who has cleared the principal outstanding, accrued interest, and all foreclosure or late-payment charges with zero balance remaining on the loan account.
Any borrower who has fully repaid a home loan, vehicle loan, gold loan, personal loan, or education loan, needing to recover original property documents, remove vehicle hypothecation from the RTO Registration Certificate (RC), or rectify active loan statuses on credit bureau reports (CIBIL/Experian).
Obtain the final foreclosure statement from the bank, remit the exact closing balance, and ensure the loan account ledger reflects 'Zero Outstanding' (₹0.00).
Submit a written closure application or apply online via net banking/customer service portal requesting the issuance of the No Dues Certificate and handover of original title deeds.
The lender retrieves your original title deeds (Sale Deed, Mother Deed, Encumbrance Certificate, Sanctioned Plan) from their central vault. Under RBI rules, you must be notified of the exact date and branch for document collection within 30 days.
Thoroughly inspect each original document to confirm zero tampering or damage, verify all pages against the original deposit receipt, and sign the bank's release acknowledgment.
For car and two-wheeler loans, collect two original signed and stamped copies of RTO Form 35 along with the bank's official NOC letter to submit to the RTO for hypothecation cancellation.
Merely holding the NOC does not automatically clear the legal encumbrance on public registries:
Apply online on the Parivahan portal (parivahan.gov.in) under 'Application for Hypothecation Termination', pay the RTO fee (₹100-₹200), and upload the bank NOC and Form 35. The RTO prints a fresh, unencumbered Smart Card RC.
If your home loan involved a 'Registered Mortgage' or 'Equitable Mortgage with Sub-Registrar', the bank must execute a formal 'Deed of Reconveyance' or 'Release Deed' at the Sub-Registrar Office to extinguish their charge in the Encumbrance Certificate (EC).
Banks report closures within 30 to 45 days. If the status remains 'Active' on your CIR, raise an online dispute on the CIBIL portal attaching the NDC to force immediate closure.
For unsecured loans (personal loans, credit card EMIs, consumer durable loans), leading banks (HDFC, ICICI, SBI, Bajaj Finserv) allow direct PDF download:
Sign in to your net banking portal or lender mobile app.
Go to 'Loans' → 'Closed Accounts' or 'Service Requests'.
Select the closed loan account number and click 'Download No Dues Certificate / Closure Letter'. The PDF is generated instantly with the bank's digital seal.
Legal avenues when lenders delay returning deeds or issuing NOCs.
| Problem | Underlying Cause | Legal / Escalation Action |
|---|---|---|
| Bank has lost original property title deeds | RBI Circular RBI/2023-24/60 Paragraph 6 | The lender must bear all costs to obtain certified copies from the Sub-Registrar, publish public newspaper notices, issue an official indemnity certificate, and pay ₹5,000/day compensation. |
| Bank delays document release beyond 30 days | Date of final repayment vs current date | Send a formal notice to the Principal Nodal Officer of the bank claiming statutory compensation of ₹5,000 per day. If unresolved, file an immediate complaint on the RBI CMS portal (cms.rbi.org.in). |
| Closed loan still showing as active on CIBIL after 90 days | Check whether bank submitted monthly data to CICs | File an online dispute on cibil.com attaching the NDC. Under CICRA rules, the bank must update status to 'Closed' within 30 days or face ombudsman penalties. |
| RTO Form 35 has expired (validity lapsed) | Most RTOs accept Form 35 within 90 days of issuance | Approach the lending branch with the expired forms; banks are mandated to re-validate or re-issue Form 35 without levying charges. |
Under RBI Circular RBI/2023-24/60 dated September 13, 2023, if a bank or NBFC damages or loses original property documents, they must bear all financial costs to obtain certified true copies from the Sub-Registrar, publish public notices in newspapers, and obtain legal certificates. In addition, if the delay exceeds 30 days, the lender must pay the borrower compensation of ₹5,000 for each day of delay.
No. Until the bank issues Form 35 and an official NOC, and you submit them to the RTO to delete the hypothecation from the RC, the bank remains the legal co-owner of the vehicle in RTO records. The RTO will strictly block any vehicle ownership transfer under Section 51 of the Motor Vehicles Act.
Most Regional Transport Offices (RTOs) require Form 35 and the bank NOC to be submitted within 90 days of issuance. If not submitted within this window, the RTO may demand a re-validated NOC or fresh Form 35 from the lender.
Visit the lending bank branch and submit a formal request for a 'Duplicate NOC'. You will be required to execute an Indemnity Bond on non-judicial stamp paper (usually ₹100 or ₹200) indemnifying the bank against any future claims, along with a fee of ₹250 to ₹1,000.
A Closed loan means you repaid 100% of the loan amount, interest, and charges as agreed, which boosts your credit score. A Settled loan means the bank accepted a compromise lump-sum payment less than what was owed; this remark remains on your credit record for 7 years and severely damages future loan eligibility.
Mandates 30-day timeline for return of all original title deeds post-repayment and prescribes ₹5,000/day compensation for default.
